Consent to Electronic Records and Signatures (E-Sign)

This Consent to Electronic Records and Signatures is your agreement that Gether may give you every agreement, disclosure, notice, statement and other communication about your account in electronic form instead of on paper, and that an acceptance you give electronically has the same effect as a signature by hand.

This version is dated September 26, 2026. You accept it in the app or on the website, and your acceptance is recorded with this version's label and the checksum of this exact text (Part 9).

In this Consent "Gether", "we" and "us" mean Gether, the operator of the Service, and "you" means the person who holds the account. "Records" means the communications listed in Part 3.


Part 1. What you are agreeing to

1.1 By accepting this Consent you agree that Gether may give you Records in electronic form, and that when you accept an agreement electronically that acceptance has the same effect as signing it by hand. This Consent is given under the federal Electronic Signatures in Global and National Commerce Act and the state laws on electronic transactions that apply to you.

Part 2. This Consent is required to use the Service

2.1 The Service is delivered entirely through the app and the website. There is no paper channel and no branch. You are not required to consent; you are required to consent in order to use the Service. If you do not give this Consent, Gether cannot open an account for you, and if you withdraw it later Gether cannot keep your account open. Part 7 explains what withdrawal does.

Part 3. What this Consent covers

3.1 Records include, at least: the Terms of Service and every new version of them; the Account and Cardholder Agreement; the Gether Fee Schedule; the Privacy Policy; the Tokenized Securities Disclosure; this Consent; any further terms Gether publishes for card purchases; the disclosure shown to you before your card is activated; monthly statements; the record of every card purchase and what is owed on it; notices that a purchase is due, past due, held, called, being sold to cover, sold, paid back or returned; notices about fees and estimates and their true-up; notices that Gether is changing a document; notices that Gether has frozen, suspended or closed your account or your card; the outcome of a dispute or a complaint you bring; tax records Gether produces for you; and anything the law says Gether must give you in writing.

Part 4. How Gether delivers Records

4.1 Gether delivers Records in the app and on the website, where a Record is available for you to read and keep, and by email to the address on your account. Where a notice is time sensitive, Gether may also send a short message by push notification to a device where you have turned it on, with the full Record in the app.

4.2 A Record is delivered when Gether makes it available in the app or sends it to the email address on your account, whether or not you open it. A short message sent alongside it is a courtesy and is not the delivery. Do not rely on receiving a push notification; the app and your email address are the two channels that matter.

Part 5. What you need in order to receive Records

5.1 To receive and keep Records you need: a device with a current web browser, or the Gether app on a supported device; an email address that works, that you check, and that can receive mail from Gether; enough storage, or a printer, to keep a copy of anything you want to keep; and the ability to open documents delivered as web pages or as PDF files.

5.2 If these requirements change in a way that creates a material risk that you cannot access or keep Records, Gether tells you and gives you the chance to withdraw this Consent without a charge.

Part 6. Keeping your contact details current

6.1 You must keep the email address and the phone number on your account current, and tell Gether promptly when either changes. You can change them in the app.

6.2 Delivery to the details on your account is delivery to you. If your email address stops working and you have not updated it, Gether has still delivered the Record, and you are still bound by a notice you did not read. That includes a notice that Gether is about to sell assets set apart for a purchase.

Part 7. Withdrawing this Consent

7.1 You may withdraw this Consent at any time through the support door in the app.

7.2 Because the Service has no paper channel, withdrawing this Consent means Gether cannot continue to provide the Service to you. In practice, withdrawal starts the closing of your account: every open card purchase must be repaid or will run its course under the Terms of Service, and the assets that remain are returned to an address you name.

7.3 Withdrawal takes effect after Gether has had a reasonable time to act on it. It does not affect the validity of any Record delivered, or any agreement accepted, before it takes effect.

Part 8. Paper copies

8.1 You may ask Gether for a paper copy of any Record Gether is required to give you, through the support door in the app. Gether does not charge for a paper copy.

Part 9. How your acceptance is recorded

9.1 When you accept a Record electronically, Gether records at that moment: which document it was, its slot and its version label; the SHA-256 checksum of the exact text that was on your screen, which must equal the registered checksum or the acceptance is refused; the moment you accepted; the surface you accepted on; your network address and client identifier where present; and a signature Gether can re-verify.

9.2 The text of every registered version is stored so that it cannot be altered afterwards, and the checksum makes any alteration detectable. Gether keeps the record so that what you agreed to can be produced later rather than asserted. Accepting one version of a document is not acceptance of a later version: a new version needs a new acceptance.

9.3 You can read the current version of every document, every version you accepted, and the checksum of each, in the app. Acceptance records are kept for as long as the law requires and as the Privacy Policy states.

Part 10. Changes to this Consent, and contact

10.1 This Consent is registered as a document with a version label and the checksum of this exact text. A change is a new version with a notice period, as the Terms of Service, Part 21 describe.

10.2 Contact Gether through the support door in the app, or through the ways to reach us published on the support page of the Gether website.

Important disclosures

  1. Spending against a portfolio carries real risk. Stocks and digital assets are volatile, and the spending power your positions support falls with them.
  2. Drawn balances have to be repaid.
  3. When your collateral falls below the required level, a position can be sold to settle what you owe, which may realise a gain or a loss and may have tax consequences.
  4. Gether is in a waitlist phase and Gether is not a bank. The Terms of Service, E-Sign Consent, Account Agreement, Fee Schedule and Securities Disclosure linked below are the registered documents members accept in the app, each with its version and checksum. The Privacy Policy is in effect.
